Filsafat Hukum tentang Keterikatan Geografis Nadzir dan Objek Wakaf dalam Perspektif Maqasid al-Syariah Ekosentris

Waqf as a religious and social instrument in Islam has great potential in supporting ecological sustainability, but modern waqf regulations and practices often ignore the geographical connection between the nadzir and the waqf object. In fact, in the context of maqasid al-syariah, spatial proximity has important implications for the effectiveness of management and the sustainability of the social and ecological functions of waqf. This study aims to analyse the ontological and normative foundations of such geographical ties within the Islamic legal tradition and to formulate region-based maqasid al-syariah as a framework for regional waqf policy planning. The method used is normative legal research with an approach based on Islamic legal philosophy and maqasid al-syariah, supported by qualitative analysis of classical fiqh literature, contemporary waqf regulations, and modern Islamic legal sources. The research findings indicate, first, that geographical ties have a strong maqasid basis and can be categorised as a normative principle supporting ecological justice and accountability in waqf management. Second, this study offers the concept of an ecocentric maqasid al-syariah and a geospatial-based regional waqf policy, emphasising the importance of the local context in planning and preserving the ecological functions of waqf. These findings expand the horizons of Islamic law towards social justice and environmental sustainability.
